在StockX购买到重大瑕疵的运动鞋

本人于2025年12月16日在Stockx.com上购买了一双运动鞋，物流投递日期是在2026年1月3日，当时我收到后只是粗略查看了下鞋子本身，但当1月28日准备穿着时，才发现这双鞋子有重大瑕疵——鞋底鼓包，根本没法穿着，此时这双鞋子我都没有上脚穿过，于是我联系StockX要求退货，但遭到拒绝，拒绝的理由是根据其所谓的条款，必须要在收件10天联系他们。

然而我并不认同StockX的说法，首先，根据《俄勒冈州修订法规》（ORS）第 72.8070 条，消费品享有至少 60 天的适销性默示担保。气泡缺陷导致该产品无法满足其通常用途。StockX自定规定的 10 天检验政策不能凌驾于俄勒冈州有关缺陷产品的州法律之上。

其次，我遇到的鞋底鼓包缺陷属于“潜伏性制造缺陷”（Latent Manufacturing Defect），在收货初期未被发现是合理的，而我的诉求只是退货而已，况且在30天内售后，属于美国商家约定俗成的退货期限。也是在被告知无法退货后我才知道StockX他们自己规定了个10天的条款，这极不公平，也不合理。

Statement

I purchased a pair of sneakers on Stockx.com on December 16, 2025. The item was delivered on January 3, 2026. Upon receipt, I only inspected the shoes briefly. When I prepared to wear them on January 28, I discovered a major defect: a bubble on the sole that renders the shoes unwearable. The shoes had not been worn at all. I contacted StockX to request a return but was rejected, with the reason being their alleged policy requiring contact within 10 days of delivery.

I disagree with StockX’s position for the following reasons. First, under Oregon Revised Statutes (ORS) 72.8070, consumer goods are covered by an implied warranty of merchantability for at least 60 days. The sole bubble defect makes the product unfit for its ordinary purpose. StockX’s internal 10-day inspection policy cannot override Oregon state law governing defective products.

Second, the sole bubble constitutes a latent manufacturing defect that was not reasonably detectable upon initial receipt. My request is simply a return, and my claim was filed within 30 days of delivery—a widely accepted return period among U.S. retailers. I was unaware of StockX’s 10-day policy until I was denied a return, which is both unfair and unreasonable.
